These Terms & Conditions (“Terms”) govern your access to and use of ev-marine.com, including any related services, applications, tools, communications, and products (collectively, the “Services”), operated by EV Marine (“we,” “us,” or “our”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least the age of majority in your province or territory of residence to use the Services or enter into a binding transaction. By using the Services, you represent that you meet this requirement.

Marketing, informational, and sales tools
Any customer portals or accounts
Communications (email, SMS, phone)
Any connected or digital services associated with our electric wake boats
3. Permitted Use
You may use the Services solely for personal, lawful, and non-commercial purposes.
You must not:
Copy, modify, distribute, or create derivative works from any content
Scrape, crawl, reverse engineer, or data-mine the Services
Interfere with security, servers, or networks
Use the Services for fraudulent or unlawful purposes
We may suspend or terminate access at any time for violation of these Terms.
4. Intellectual Property
All content, software, designs, trademarks, logos, specifications, images, and videos are owned by EV Marine or its licensors and are protected by Canadian and international intellectual property laws.
No rights or licenses are granted except for limited personal viewing. Any unauthorized use is strictly prohibited.
5. User Accounts (If Applicable)
If you create an account:
You are responsible for maintaining confidentiality of login credentials
You agree to provide accurate and current information
You are responsible for all activity under your account
We may suspend or terminate accounts at our discretion.
6. User-Generated Content (If Applicable)
If you submit content (reviews, photos, feedback):
You grant us a non-exclusive, royalty-free, worldwide license to use it
You represent that you have the right to submit the content
We may remove content at our discretion
7. Website Content Disclaimer
The Services and all content are provided “as is” and “as available.”
We do not warrant accuracy, completeness, or suitability of any content, including specifications, pricing, imagery, or availability.
8. Third-Party Services and Links
The Services may reference or link to third-party services (financing, insurance, analytics, connectivity). These are governed by their own terms, and we are not responsible for third-party content or practices.
9. Products and Orders
We market and sell electric wake boats and related products and services.
All listings are informational only and do not constitute a binding offer.
Orders are not accepted until confirmed in writing or through a separate purchase agreement.
10. Pricing, Taxes & Fees
All prices are in Canadian Dollars (CAD) unless stated otherwise and may exclude:
Applicable federal and provincial taxes
Freight, delivery, documentation, and service fees
We reserve the right to correct errors and cancel affected orders.
11. Deposits, Cancellations & Refunds
Deposit requirements, cancellation rights, refunds, and delivery timelines are governed by:
Written quotations, and/or
A separate purchase or dealer agreement
In the event of conflict, the purchase agreement prevails.
12. Warranties
Any warranties are:
Provided by the manufacturer, or
Expressly stated in writing at the time of sale
Except as required by law, all implied warranties are disclaimed.
13. Connected Product & Usage Data (If Applicable)
If our boats or systems collect operational, diagnostic, location, or performance data:
Such data may be used to improve products, safety, and services
Data handling complies with Canadian privacy laws

14. Limitation of Liability
To the fullest extent permitted by law:
We are not liable for indirect, incidental, consequential, special, or punitive damages
Our total liability is limited to the amount paid by you for the applicable product or service
Nothing limits statutory consumer rights.
15. Force Majeure
We are not responsible for delays or failure to perform due to events beyond our reasonable control, including natural disasters, supply chain disruptions, labour disputes, government actions, or pandemics.
16. Electronic Communications (CASL)
By providing contact information, you consent to receive communications in accordance with Canada’s Anti-Spam Legislation (CASL).
You may opt out at any time via unsubscribe links or replying “STOP” to SMS messages. Consent is not a condition of purchase.
17. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada.
18. Arbitration & Class Action Waiver (Optional – Based on Arc Boats Model)
Except where prohibited by law, disputes shall be resolved by binding arbitration, not in court.
Arbitration will be conducted in British Columbia, Canada
Each party waives the right to participate in a class action
You may opt out of arbitration within 30 days of first acceptance by written notice
19. Termination
We may suspend or terminate access to the Services at any time for violation of these Terms or applicable law.
20. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services constitutes acceptance of the revised Terms.
